Buying a business?
Buying a business can be an exciting but stressful time. We act on behalf of a range of clients in preparing and/or reviewing documents, negotiating with other parties, assigning leases if required and facilitating the transfer of funds and ownership at settlement. Selling a business?
Selling a business can also be stressful. We act on behalf of a range of clients at all stages of a business sale from providing advice, to negotiating with potential purchasers, preparing contracts of sale, preparing the documents necessary to transfer the ownership of the business, assigning the lease to the buyer and attending settlement on your behalf.

Wills
If you are over 18 and you don’t have a will, we recommend that you get one as soon as you can, as the best way to ensure that once you pass away, your family members are properly provided for.

Essentially, if you die without a will, there is no guarantee that your assets will be distributed as you would like them to be and no guarantee that your children (if any) will be left with the guardians you had imagined. We will assist in making sure that the likelihood of estate disputes is reduced.

Estates
The death of a close friend or family member can be a very difficult time, even without thinking about whether or not they have a will and how they might want to distribute their assets.

We can assist you with all aspects of administering a loved one’s estate, transferring property to beneficiaries and collecting all necessary information to complete all transfer of property to the named beneficiaries. Many of our clients have thanked us for being such a support at this difficult time.

Probate
Where a person dies without a legal Will, the law determines who will receive the estate. In this instance, letters of administration need to be obtained from the Supreme Court, which will allow the assets and liabilities of the estate to be dealt with.

Letters of administration authorise a person (called an administrator) to administer the deceased estate and distribute assets.

Even when there is a will, and there a ample assets held in shares or in the bank, a third party may require a Probate Application to be completed so as to ascertain that the last Will of the Deceased is the current Will.

Each estate is different and you should seek legal advice from a deceased estate lawyer about your position before deciding whether it is necessary for you to obtain a grant.

Succession
While it can be difficult to think about your death, it is important to consider what you would like to happen to your personal and business assets when you pass away.

We are able to discuss these issues with you and provide you with advice in relation to how you can make sure that your wishes are honoured following your death.
